My wife has an expired green card. What can I do to bring her back to the US legally?

If your wife has been outside of the country for more than 1 year, without a valid excuse, it is likely that immigration will deem that she has abandoned her residency in the United States. In which case, you will need to submit another I-130 petition on her behalf and start the immigration process all over again. The paperwork should be completed in about 1 year, and she should be able to return to the US after she receives her immigration visa from the US consulate.

Time out of status is forgiven upon approval of an I-485 based on marriage to a US citizen, so a late filing is technically OK. If she overstays the I-94 by 180 days or more, she should not travel outside of the US as she will trigger a bar to reentry.

If he is not in legal status or if you have not received approval for the waiver of the bar, please make sure he doesn't subject himself to the 10-year bar by leaving the USA. Many people leave, only to be shocked when the Consul tells them they can't return for 10 years.
