Should I go for H1-B Visa stamping on Company-A where I work or Company-B which got my H1-B transferred but I never joined Company-B?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Where you are sponsored by company A, later sponsored by company B for H-1B transfer, but never work for Company B and instead continue with company A, you are not obligated to work for company B. When you leave the US in order to have your H-1B visa stamped, you should use the form I – 797 from company A. You may wish to check with company B in the future to see whether it has already canceled your approval. Most prudent companies would have already done so if they knew that you were not going to join them. Can I fix my papers if I get married to a US citizen?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
As long as you did not return to the US illegally after you were deported, you are still eligible to return to the US after you have applied for and been granted waivers on forms I-212 and/or I-601. To get the process started, your girlfriend can petition for you on form I-130 after you have been married to each other. If you are eligible, the waivers will be requested by the US consulate at the time of your visa interview.
