My b2 Visa will expire feb 22. Can I ask for extension?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Although this answer may not help you at this point (it being after February 22), anyone who is in the US with a valid B-2 status is allowed to request an extension with U.S.C.I.S. on form I-539 application to change or extend status in the United States. Such application should be filed with an explanation of the reason why an extension is required, proof of financial ability to remain in the US during the requested period of stay without working, and proof of arrangements to leave the US on or before the ending date of the requested extension. A note of caution should be inserted that U.S.C.I.S. denial after the date of valid B-2 status expiration automatically invalidates the visa in the passport. Does my husband have to stay in his home country during the immigration process?

Answered by attorney Eric M. Mark
Immigration lawyer at The Law Office of Eric M. Mark
If you have a lawyer, you need to speak with your lawyer. If you do not have a lawyer, you are being foolish. It appears your husband is barred from the U.S. for 10 years for being in the U.S. illegally, otherwise he would not have to return to Honduras. If that is the case, he must obtain a waiver, which is a difficult thing to do under any conditions, but particularly without a lawyer.

Do I have to stay in the United States if you get married for citizenship?

Answered by attorney Eric M. Mark
Immigration lawyer at The Law Office of Eric M. Mark
It depends on what type of visa your spouse has. You may have to wait some time after the marriage until she obtains a travel document or permanent residence, and then she should obtain a reentry permit in case your trip lasts longer than expected. You should speak with an immigration lawyer to get better details and make sure you understand.
