You can and should apply for the green card. The process, in New Jersey, takes about six (6) months.

Unfortunately, you cannot petition yourself. Someone else must petition for you. You want to contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation to see if you qualify for VAWA or any other waivers. He/she would then be in a better position to analyze your case, advise you of your options and make sure that the necessary paperwork and documentation is presented so as not to delay the process.

We have filed I-130, how long will it take to join my US citizen wife in US?

The I-130 usually takes about 6-9 months for approval and then you apply for the immigrant visa at your home consulate. That process varies significantly depending on the consulate. You can check to see if they have an online posting of the processing times.
