How does kid 18 brought here from Columbia graduated HS stay in the US?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
It is not a felony to enter without inspection or overstay a visa. It is a civil immigration violation. It is unclear what his status is. If he entered with a visitor visa, then there is hope that if your daughter decides to marry him, she can petition him for a conditional green card, since she is a U. S. Citizen. In addition, the new provisional waiver program provides hope. In fact, if he departs at the right time, he may even be able to avoid more serious consequences, because it is unclear when he turned 18 years old at this point.

If the K1 visa was denied, should I start a CR-1 visa?

A denied K-1 visa at the U.S.Consulate in the Dominican Republic is not likely to turn into an approval, and waiting could take years. Your suggestion of getting married and starting all over with an I-130 is not a bad idea. On the other hand, it's no guarantee they won't re-deny for the same ridiculous reason. And, should you choose to hire a lawyer, our law firm is happy to represent in these types of cases.

What can I do if I was terminated by the language school I used to attend?

From an immigration standpoint, a person in this situation will typically either leave, or, maybe apply to switch to a B-2 visitor status. Also, the student may have contract rights against the school, if the school is in breach of an agreement.
