I need more information regarding the crime: 1) What was the exact conviction? 2) When was the conviction? 3) Did he plea guilty or no contest? 4) Did he have an immigration lawyer's advice? 5) What was the sentence of the crime? 6) How much time did he actually serve? 7) Did he have the green card? If so, when and how? 8) Where was the crime? 9) What the court Federal or State?

Yes these cases are doable but a higher burden to show your good faith marriage. Keep evidence of your travel to see each other, phone and email contacts, etc.

Can a DACA applicant apply for a medical marijuana card?

Possession of marijuana in low levels is generally regarded in many states as either legal or a violation rather than a misdemeanor or felony. That being said, federal law allows individuals to be removed from the country who are in possession of over 30 g of marijuana (There is an exception for possession of 30 g and less for one's own use). So it is not safe for a DACA applicant to apply for a medical marijuana card if the individual actually intends to use it. And of course it would lead to questioning by DHS if the DACA holder was encountered by ICE and the card was discovered.
