Depending on the crime for which your father was convicted and served 5 years for, it may not be possible for him to return to the U.S. I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your father's conviction and deportation. He/she would then be in a better position to analyze you case and advise you of your options.

I would not call it normal, but it does happen for a number of reasons such as a backlog, incomplete background checks, etc. I suggest that you make an info pass appointment with your local immigration office and request an update on your file.

You could certainly file an I-130. The problem is with the I-485, which requires proof of legal entry, or proof that she qualified for the last amnesty by having filed something on or before April 30, 2001.
