How does my arrest record affect the I-485 application?

Answered by attorney Kenneth G. Wincorn
Immigration lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
I have considerable experience dealing with cases similar to yours and can advise you that it will be a long and difficult effort to succeed. You will need legal help, either through an agency like Catholic Charities or other provider of legal help or a private attorney with experience in both criminal and immigration cases. If you try without help, it will be extremely risky.

Could music production for a mixtape and for free, be classified as a volunteer act?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
U.S.C.I.S. will generally look to see whether individuals have been paid or compensated in other ways in deciding what is a volunteer activity. A hobby in which you are not being compensated would not be considered unauthorized employment. The advice that you have received that the volunteer activity should be regularly done by volunteers is probably advice on the more cautious side. The main concern would appear to be whether you are compensated for your activities. Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. No Attorney/Client relationship is or shall be construed to be created hereby. Can I come back to the US with a dismissed misdemeanor?

Answered by attorney Hugo Florido (Unclaimed Profile)
Immigration lawyer at Florido & Associates, P.A.
No you should have no problems in re-entering. Of course, you called always be questioned in a deferred inspection, but a dismissed misdemeanor is not enough to make you ineligible to re-enter.
