Im starting to fill the i130 for my parents they are in usa as a tourist visa will i have to fill the i485 for both, or should i fill one for each?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Whether you file the I-485 petitions depends upon your intent and that of your parents. If they wish to return overseas soon, you would file separate I-130 petitions for them, and they would consular process their immigration later on forms DS-260 Application for Immigrant Visa with the National Visa Center after the I-130 petitions are approved, and interview for the immigrant visas at the designated embassy or consulate in their home country. If you and your parents decide that they should remain in the US, you can file concurrent I-130 petitions (one for each parent) along with I-485 applications (again, one for each parent). Is it possible to sponsor my husband who entered the US illegally?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
Maybe - I would need to review the complete immigration and criminal history for him, whether any family members have ever filed petitions for him, are his parents or grandparents U.S. citizens or permanent residents, the details of how he entered the U.S. (I know it was without papers but we need to determine if he was in fact "inspected, "etc. This will tell me whether he is eligible to file in the U.S. or must go overseas. If he is under 18 years and 6 months he needs to seek legal advice immediately as he may be able to avoid the need for a waiver even if he must go overseas.
