It appears that the answer is up in the air because of the Trump travel ban on five mostly Muslim countries including Iran and the unwillingness of the State Department to grant waivers which supposedly can be given to especially those with close family ties to US citizens. As of April 2018, only 579 waivers were granted from 33,176 applicants. Yes, if you have the skills and educational background required by an employer to want to hire you, the employer can apply to the government to seek a work permit for you. In many cases, the employer will be required to show that they have unsuccessfully tried to find a US citizen worker to fill the position prior to applying for you and that they can pay the usual salary for you that the position attract in the market where the job position is located.

The change of name should not affect your petition for your daughter. As the case is sitting at the NVC at this time, you can notify the NVC of your name change with a copy of your marriage certificate. You do not have to do anything with USCIS as your daughter’s case is no longer in its offices.
