If you are in a jurisdiction where secure community is in effect, such as in California, ICE will have your information after your arrest. It is very possible that ICE will detain you or if you are arrested by the police, a hold will be placed in your file so you cannot be released from the police detention. You should retain a criminal attorney to represent you in the criminal court. You may not need to appear in court right away (depending on what is the charge).

If she overstayed her visa or came here illegally, she will need a waiver to overcome her illegal presence in the U.S. I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your mother's situation. (S)he would then be in a better position to analyze your case, advise you of your options and, if possible, make sure that the necessary paperwork and documentation is properly presented so as not to delay the process.
