When she is added to form i130 and i485, does this allow for her to immigrate under the principal beneficiary?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Your daughter may qualify as a derivative beneficiary of your husband's application for you in the Immediate Relative visa category, and that process does require a separate Adjustment of Status application for the child. For a process this important, especially where you are not thoroughly familiar with the legal requirements, it would be wise to work with an immigration attorney.

Hi. No, he will not lose his US citizenship. He can leave for as long as he wants. He should just make sure his passport is good for a few years.

Can I get a legal status if I have two kids born in the US?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Giving birth to children in the U.S. does not create eligibility for immigration benefits, although generally when a U.S. citizen child reaches age 21 he/she will be able to sponsor a parent in an application to become a Permanent Resident. It would be wise to explore other potential avenues for the parent to seek immigration benefits.
