Can my mother travel with us now on visitor visa if today, I got an I485 denial and I130 approval for her?

Answered by attorney Myron Russell Morales (Unclaimed Profile)
Immigration lawyer at Quan Law Group, PLLC
The question that will arise will be whether she has non-immigrant or immigrant intent, so you will need to show strong ties to her home country. Much will depend on the reason that the I-485 was denied. If they found that she violated her underlying non-immigrant status, then it may not be advisable to travel on the visitor's visa. You should have an attorney review the documents so they can give you more specific advice.

When marrying a foreigner national (Philippines) who is here legally on Tourist Visa, do I apply for status adjustment/change before or after marriage

Answered by attorney Bruce A. Coane (Unclaimed Profile)
Immigration lawyer at Coane & Associates, PLLC
This is all very complicated and I'd suggest using a board certified immigration lawyer. You can review the complicated forms and instructions and look for forms I-130,485,864, and G-325A. And, yes, you must be married in order to sponsor your wife and her child.

If I have been a US citizen for 10 years, can I petition to bring my parents and brother from France?

Answered by attorney Eric Arden Fisher (Unclaimed Profile)
Immigration lawyer at The Law Office of Eric A. Fisher, LLC
If you are over 21 years old, you can apply for your parents and when the petition is approved they can apply for immigrant visas. You can file a petition for your brother now, but he will have to wait more than 10 years to apply for an immigrant visa.
