Yes,. We just had a similar case where the US Consulate refuse to issue the visa; and sent back the case to the USCIS for revocation of approval of the Form I-130. We were able to present evidence to the USCIS and persuade said agency to sustain its approval of the petition and the case was sent back to the US Consulate. Contact an attorney.

If you are talking about earning a living in the U.S., the answer is "you can't". B-1/B-2 visas are non-immigrant visas for which work authorization is not allowed.
