In order for your husband to successfully petition for you without having to return to your home country, your husband must get his citizenship first. If he does not make sufficient income, you may use up to 2 joint sponsors to help him meet the minimum income requirement.

Just applying for WIC will not make you ineligible; but most nonimmigrant classifications require you show you will not be a public charge. Did you also overstay your visa without applying for an extension? There are no H visas available until October 2013 but you may call to set up a consultation to discuss other option.

She is subject to 10 year bar. She will not qualify for a visa unless a waiver is approved and it is almost impossible to get the waiver for a non-immigrant visa. If you are a USC and over 21, you may file a petition for your sister but she has to wait for her priority date.
