Is there any way my husband can stay in the US legally?

Answered by attorney Kenneth G. Wincorn
Immigration lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
It is very doubtful that there is any way for him to avoid deportation. Any charge of drug possession over 30 grams of marijuana results in an aggravated felony finding and a lifetime bar from the U.S. It may be helpful to arrange through us or another immigration lawyer of your choice for him to fly to a city in Mexico other that a border city to avoid some of the risk. Let us know if you need help.

Is there a way to get my same sex partner here as my dependent?

Immigration lawyer at Coane & Associates, PLLC
A USA citizen can sponsor their partner as a fiance. There are no boyfriend/girlfriend visas available for non-immigrants such as H-1B. Sometimes they can get a B-2 visitor visa. If you marry, they can get an H-4.
