Can I marry and apply for adjustment of status during the grace period of my J1 visa or would I have problems with my case?

Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
The situation depends on whether your J-1 visa has the requirement that you go back to your country for 2 years after completing the J-1 program. If you are subject to this requirement, chances are that you will not be able to adjust status: even though there is a waiver of the 2-year foreign residency requirement, it is very seldom granted. If your J-1 visa does not obligate you to live in your country for 2 years after completion of your J-1 program, if you marry a U.S. citizen, and if you have no statutory disqualifications (for instance, criminal convictions), you should be able to adjust status despite getting marries after expiration of your J-1 status.

How much time would it take to transfer from H1 to green card?

It's not a transfer. If you are an LPR and you petition for him, he is an FB-2A. That family-based preference classification has a backlog to July 22, 2009. You need to file the I-130 to get him the priority date. You must consult with an immigration attorney to make sure that the filing will not conflict with his non-H-1B NIV options.

What document do they need to file to change his status if his I94 has no expiration date?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
It depends, but it appears as if your sister and nephews/nieces may already be out of status, especially if they entered the US merely as visitors and it has been 10 years since they left. However, your nephews and/or nieces may be eligible to apply for Deferred Action for Childhood Arrivals to get temporary work permits, which can be used to renew your nephew's driver license, if they entered the US before their 16th birthday and are currently enrolled in school or have graduated from High School.
