Can I marry her directly with the help of this country’s DIVORCE certificate or I have to DIVORCE in US too, with my ex-wife?

USCIS will recognize foreign divorces. So you can marry a US citizen without having to reapply for the divorce in the US. If done right, you should be able to get a green card in about 3 months.

Legal name change after marriage but NO status right now

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
Changing a name based on marriage is simple and doesn't usually require court intervention.  You just show your marriage certificate to most of those involved and they will allow you to change to your married name.  For example, driver's license, social security, banks, etc. will all simply change your name on your request if presented with the marriage certificate.

What is the best way to file for a I-130 adjustment?

The B-2 visitor visa is for a temporary visit, not to enter the US to marry a US citizen and apply for permanent residence. The correct visa is the K-1 if you are engaged and if you are married, the K-3 visa. If she enters the US on the B-2, when you apply for permanent residence, the case could be denied citing visa fraud for using the incorrect visa to enter the US. Thank you.
