Absolutely you will need to mention this and obtain a certified copy to include with your green card filing even if the record is from when you were a juvenile and is sealed. I suggest an immigration attorney guide you through what to submit and to advise if the record itself will pose a problem to your obtaining permanent residency and whether a waiver will be required.

There are a lot of variables involved with this question. Namely, did the person enter the U.S. legally? Does the person have a U.S. Citizen spouse? Has the person ever been a victim of a crime in the U.S. and reported it to law enforcement? The possibility of gaining legal residency is there but only if the person qualifies.

If you mother is US Citizen or Green Card holder and she lives in the US she can be the co-sponsor for your husband. You still have to be the petitioner and sponsor, but she can also file an Affidavit of Support for him.
