When can my Us citizen son apply for us as a family for green card. he is 16?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
A U. S. citizen child must reach the age of 21 before being able to sponsor parents and siblings. Prior to the change of law in 1976, babies could petition for parents and siblings, but Congress became alarmed and raised the age limit to its present 21. Should I still submit form I131 even though I don’t plan to travel in the time and wait for my green card?

You are not required to submit form I-131 when you apply for adjustment of status. The application can be submitted free of charge at any time while your I-485 application is still pending before USCIS. You will also need to submit a copy of the I-485 receipt notice along with the application.

Can I get a greencard if I've been deported but am married to an American?

Answered by attorney Eric M. Mark
Immigration lawyer at The Law Office of Eric M. Mark
You have a chance, albeit is a small one. You will need to obtain at least two waivers based on hardships to your husband and child. You are going to need an attorney to have any chance at success. Call me for a consultation.
