Not so much a problem, but a concern for the validity of the current marriage. You should have evidence of the abuse, such as, police reports, etc. I recommend that you get a lawyer for detail consultation.

I am not sure what 217 10000 means, but the usual advice in situations like yours would be to apply for a student visa directly at the American consulate or embassy, and explain your refusal under ESTA at the visa interview.
