Like any F-1 student he will need to demonstrate that he is only coming temporarily and intends to return. Being married to an LPR will make this more difficult but not impossible. Make sure he is completely truthful on his application about having an LPR spouse and include his statement that you are filing an I-130 petition for him but he understands he will need to return abroad to process for his immigrant visa or sooner if his F-1 expires and show his ties to the home country.

Regrettably, the State of Georgia still does not recognize same-sex marriages (although a lawsuit is now pending to challenge that restriction). In the meantime, same-sex couples living in Georgia may marry in another state and return to Georgia to process marriage-based applications for adjustment of status, since they are governed by federal, rather than state, laws.

Is she in jail pending criminal charges or does immigration have custody of her?  If she is facing criminal charges, she is entitled to an attorney at no cost to her and that attorney will help her.  That attorney should consult with an immigration lawyer (like me) to ensure that any result in the criminal action has to most favorable immigration consquences for your friend.
