How can I upgrade from f2b to f1 preference?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
The procedure to upgrade depends on whether your I-130 has been approved or is still pending. If approved you send a copy of your naturalization certificate to the National Visa Center - they should have assigned you a case number; if still pending, the naturalization certificate should be sent to the address on your I-130 receipt with a copy of the receipt and a note requesting the case be upgraded to FB-1. You want to be sure that FB-1 is more favorable for your country before doing this - for the Dominican Republic it is. When did you file the Petition for your daughter. The date on the Visa Bulletin indicates the Priority Date for your case. The Priority Date is the date your I-130 was actually received by USCIS. This should be on your I-130 receipt. If you move it is most important that you notify the agency that has your case of the new address. If your case has been pending for too long and you haven't heard anything, you or someone on your behalf needs to inquire about what is going on so it won't be denied for failure to respond to a request for more evidence.

Revoke my sentri card

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
You don't have a right to the processing offered to SENTRI card holders.  They can revoke the card at any time for any reason and there is nothing you can do about it.  It just means you have to processes entry in the standard fashion.

What happens if I have a DUI after my interview?

Brian D Lerner
Answered by attorney Brian D Lerner (Unclaimed Profile)
Immigration lawyer at Law Offices of Brian D. Lerner
Yes, it would most likely affect the Naturalization. *Criminal Evaluation* At this point, it is critical that you obtain the Criminal Evaluation by an Immigration Attorney. Neither the Criminal Attorney or the Criminal Judge are aware of how your particular criminal situation will affect your immigration status. There is no reason to plea to something in criminal court that will only hurt your chances of remaining in the U.S.. My firm can prepare the necessary Criminal Evaluation which will document to you and the Criminal Attorney exactly what is your immigration situation and the best alternatives for a plea that will have the least effect on your immigration status and will minimize the damage that could occur in future deportation hearings.
