Will I get denied for green card renewal if I've invited my mother to the USA and she stayed here with expired visa?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Your inviting your mother to the US and her staying with an expired visa has no relevance to your ability to renew your green card. Green card renewal is more concerned with whether you have committed crimes, but the main purpose for which U.S.C.I.S. requests green card renewals is to maintain the security of the cards. Over time, counterfeiters have been able to duplicate many of the features of the green cards, and so the agency has placed time limits on cards that it now issues and puts in a number of new security features periodically.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. A NY Disorderly Conduct and citizenship

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Your guilty plea to disorderly conduct would not make you excludable or deportable. That being said, admitting to the truth of facts supporting a charge of possession could make you inadmissible at a port of entry as the law of excludability does not require a conviction, only admission of having committed acts which constitute the essential elements of an excludable offense. How can I get my husband legal residence and what’s a reasonable price to pay an attorney?

Answered by attorney Jennifer Maude Oltarsh
Immigration lawyer at Oltarsh & Associates, P.C.
You will be eligible to benefit from the new policy of asking for waivers of inadmissibility in the United States. Under the current law, because you entered without inspection you will have to return to your home country to obtain you residence. The new policy is designed to allow that trip to be fast and with much less uncertainty. Waivers are based on individualized facts.
