When Can My Husband Apply for Citizenship

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Since you are discussing 18 months of physical presence, I gather that you are a U. S. citizen and that your husband is applying on the three-year basis. An easy way to determine the 18 month physical presence fulfillment is to count back 18 months from the date that he intends to file the N-400 application.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. How could I bring my boyfriend to the U.S.A on a fiance visa?

Answered by attorney Kenneth G. Wincorn
Immigration lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
This is called a K visa and it is exactly what is needed. The rules are not very complicated but it is best to consult with an attorney before applying. Certain countries are more difficult than others and will require more proof of the relationship.

Can I Divorce My Wife without affecting my status in the US?

Frank R. Sariol
Answered by attorney Frank R. Sariol (Unclaimed Profile)
Immigration lawyer at Sariol Legal Center
With the facts you are giving us, your happiness will be short lived. It is true that you can get a work permit, a social security number and a driver's license, but you have no way of getting your cancellation of removal granted. Since your wife is neither a US citizen nor a Legal Permanent Resident (LPR) your marital status does not make any difference to your immigration case. Your only hope would be for your attorney to keep you in the US until there is some type of amnesty that would grant you LPR status.
