What should I do? If I go back to France without showing up at the court house, should I come back in the US?

Immigration lawyer at The Law Offices of Peter S. Kollory
There is some hope in the adverse facts that you presented once you are in the immigration court for removal. When such proceedings are initiated in that court for removal (deportation), you may be able to seek judge's discretion who takes a "balancing of equities" test to determine if they can cancel the removal proceedings and grant you status. Much depends on the personal and public records of yours in an in-person consultation with an attorney to come to take such a risky route. Alternatively, you may have to leave the country and re-apply under another visa.

What happens to me if my spouse married me for a green card?

Answered by attorney Eric M. Mark
Immigration lawyer at The Law Office of Eric M. Mark
His green card is most likely temporary. After two years he will have to apply for a permanent card and have to prove that the marriage was entered into in good faith and that the marriage is still viable or that a divorced has been finalized. It is he who needs the lawyer. You may want to consider naturalizing to become a citizen if you have been here as a green card holder for five years or more. There are many benefits to becoming a citizen including the right to vote and knowing that you will never be deported, as well as the ability to bring certain relatives to the U.S.

Did I have chance to fill out the I-130 for my mother if her I-94 expire 2 mos ago without any problems?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
If your mother is 70 years old and still in the United States, you would be best off applying for her adjustment of status here in the States if that is the wish of both of you. For that, you would not only be filing the I-130 petition, but also the I-485 adjustment of status along with all the other related forms and documents and filing fee. The fact that she qualifies as the immediate relative of a U. S. citizen exempts her from the requirement of maintaining status in order to file for adjustment of status to permanent residence.  Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
