Can I enter the U.S. to adjust the status after applying for I-130?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
A B1/B2 "tourist visa" is for someone who plans to enter the U.S. for a temporary stay, whether for business or pleasure, and then depart in compliance with the visa. A B1/B2 may not be used by someone who intends to enter the U.S. in order to adjust status to become a Lawful Permanent Resident (to get a "Green Card"). Misuse of a tourist visa may be considered "visa fraud," which can have very severe immigration-related consequences. Depending on the dates, you may qualify for derivative citizenship where the DUI would have no bearing.

Is same sex marriage allowed in the state?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Regrettably, the State of Georgia still does not recognize same-sex marriages (although a lawsuit is now pending to challenge that restriction). In the meantime, same-sex couples living in Georgia may marry in another state and return to Georgia to process marriage-based applications for adjustment of status, since they are governed by federal, rather than state, laws.
