What can I do if my petitioner wants to get a divorce and stop my visa process?

Justin Wang
Answered by attorney Justin Wang (Unclaimed Profile)
Immigration lawyer at Sheppard Mullin
Once you marry him and filed your I-485, you can continue the process(he cannot cancel your I-485). USCIS may approve your I-485 if your marriage is found bona fide.

My husband has been here since 1999, what are the chances of him not having to leave the country to get legalized?

Answered by attorney Jennifer Maude Oltarsh
Immigration lawyer at Oltarsh & Associates, P.C.
It depends on how your husband entered. If he entered illegally, did he ever file a petition application? If he must leave, there are new procedures to file waivers in the United States so that the separation time is minimized.

Is co-sponsor allowed in k1 visa?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
Only the I-134 is required at the K-1 stage. The co-sponsor can be used once he is here, you marry and want to adjust status. I would suggest locating a job and then submit that information with a new I-134 for you and one for your Mom.
