Assuming that your boyfriend has not been previously deported, and that he did not enter the United States on the visa waiver program, he should have a right to a hearing before an immigration judge. While the rights of undocumented foreign nationals has been severely limited in the last few years, there are still some possibilities based on the number of years he has lived in the United States, his family ties here and whether his relatives would suffer if he were deported, conditions in his home country and other factors. Its very important to consult with a qualified immigration attorney so that you know your options.

The sponsoring petitioner in a family-based immigration application must file an Affidavit of Support, and if that petitioner does not have sufficient documentable income it may be necessary to have a "joint sponsor" for the application. Sufficiency of income depends upon such things as geographical location and family size.

Simply becoming married does not change anyone's immigration status, but frequently a marriage will create eligibility for one spouse to file an immigration application on behalf of the foreign national spouse. Issues that may address eligibility for a marriage-based "Immediate Relative" visa application include such things as: your citizenship; your fianc?e's current immigration status, if any; details about how and when your fianc?e entered the U.S.; etc. Especially since you appear to be less than thoroughly familiar with the immigration application process, it would be wise for you and your fianc?e to engage an immigration attorney who, after learning all of the relevant details, could advise you about immigration-related eligibilities, options and strategies and represent you in the application process.
