A conviction based on recklessness alone is not sufficient to sustain a charge of deportability for domestic violence as it does not fit the definition of a crime of violence. Although crimes involving domestic violence are ones for which there are no waivers, the crime must have a requisite mental state of intent, and recklessness in an assault case would generally not meet the standard.
