If your spouse is a U.S. citizen, you can file I-130/I-485. If you entered the U.S. legally, you can adjust status on the basis of an immediate relative immigrant petition of your U.S. citizen spouse even if you overstayed your initial admission to the U.S.

Can I sponsor my mother and sister to live in the US?

Justin Wang
Answered by attorney Justin Wang (Unclaimed Profile)
Immigration lawyer at Sheppard Mullin
You can petition for both but since the waiting time is fairly long for your sister and she cannot legally stay here while waiting, she will be out of status soon. Your mother will be fine since there is no quota and the processing time will be quick. Your mother cannot include your sister in her case.

He should file Forms I-485 and you can file Forms I-130 along with G-325's, I-765, I-131, G-28, etc. The entire process takes about 3 months from start to finish. And it is best not to travel outside the US until after the green card is received.
