You can petition for him and have him go through consular processing. He must file a waiver to get around the 10 year bar.

I was deported as a non immigrant for drug trafficing after doing a 30 month sentence ,can i ever be granted another non immigrant visa?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
You can apply for a nonimmigrant visa, be refused, and then apply for a nonimmigrant waiver to enter the US. Whether it will be granted is up to both the US Consulate or Embassy and the U.S.C.I.S. admissibility review office in the US. Factors that may affect the adjudication would be the reason for the visit, the reason for which you are barred, and whether you would pose a threat to public safety or national security, etc.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Can my husband receive papers?

Answered by attorney Kenneth G. Wincorn
Immigration lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
Unless there are other factors such as a prior petition filed before mid 2001 he will have to process outside the country. He will need a waiver to return unless he waits 3 or10 years depending on how long he has overstayed
