A USA citizen can file a visa petition for their spouse who resides outside the USA. Just make sure you get out before you have 180 days of unlawful presence or you can be subject to the three-year bar to reentry.

If you are a United States citizen over the age of 21 and you are sponsoring your mother for a green card through adjustment of status, she should remain in the United States. If she leaves the country, her 485 will be considered abandoned, and she will have to start over again.

To amend your birth certificate, you will need to contact the Mexican authority with jurisdiction over your birth records. Even if you were to amend you birth certificate, it is likely that USCIS will required both of you to get DNA testing to establish the parent-child relationship. If he wasn't married to your mother, he will also be required to prove that you were legitimized before your 18th birthday.
