My case was dismissed by BIA in 2011. I have 2 american citizen children and no criminal background. Am I eligible for DAPA?

Answered by attorney Doreen A. Emenike

Hello,   It is not clear from your question if you were ordered deported and remained in the U.S. after your appeal was dismissed, or if you were successful in fighting your deportation. At this time there is a temporary ban on DAPA so until the ban is lifted you would not be able to file for DAPA, even if you were qualified. Since you have been in deportation proceedings in the past, before you file any new immigration application, it is very important that you take your immigration court papers and speak to an experienced immigration lawyer in your local city so they  can review what happened in court and give you specific advice for your particular situation. Good luck. If my step father was getting de-naturalized would it affect me? My mom was made citizen of the u.s through marriage with him 10years ago and I and my

Answered by attorney Doreen A. Emenike

Hello,   It depends. Is the denaturalization being initiated by your step father or is it by the USCIS? If your step father has decided to voluntarily give up his U.S. citizenship for personal reasons, then neither you nor your mother have anything to worry about. If the U.S.CIS is initiating proceedings to denaturalize an individual, then it would be helpful to know why they are doing so, in order to assess any likely risk to your citizenship.   Disclaimer: This information is of a general nature and is not, nor is it intended to be, legal advice. Can a citiation affect my naturalization process?

Answered by attorney Yahima Suarez (Unclaimed Profile)
Immigration lawyer at Hernandez & Suarez, PL
You need to find out if the "citation" you received under the MN laws is considered a crime involving moral turpitude for immigration purposes. You should contact an immigration attorney in MN to help you with this matter. Traffic citations usually do not affect; however, for what you express, the citation may have involved fraud, and this COULD affect your immigration process.
