Could I file I-130 form to sponsor my parents to US while I'm still living outside the country?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Generally, a U.S. citizen age 21 or older may sponsor parents to become Lawful Permanent Residents (to get "Green Card"), and this is true even if the U.S. citizen child may be outside the U.S. In order to analyze the most appropriate steps to take, however, more information is needed. It would be wise for you and your parents to consult with an immigration attorney who, after learning all of the relevant information, could advise about eligibilities, options and strategies to attain your goals, and who then could offer legal representation in the often complex application process.

Which forms do I need to file for my stepchild to obtain his green card, his name was included on my husband's form I-130?

Answered by attorney Stephen Arnold Black
Immigration lawyer at The Law Office of Stephen A. Black
So a United States citizen can sponsor their step child for a green card, provided that child lawfully entered the United States with inspection And provided that the marriage between the stepparent and the biological stepchild parent occurred prior to the child's 18th birthday. You should retain counsel to process the case so that it goes smoothly and without delays. Counsel in any state can lawfully represent you.
