If your husband has convincing evidence that he did not engage in marriage fraud, you can appeal the I-130 determination within 30 days with all proof of the bona fides of his marriage. Yes. You can marry someone anywhere. The U.S. will recognize the marriage if both parties were legally able to marry and did so through proper authorities. For your new spouse to return to the U.S. you must prove that it is a valid marriage and apply for an immigrant visa. These proofs can be very difficult and you should hire an attorney to guide you through the process and complete the paperwork. It may also be possible to obtain a fiance visa and have your spouse come here to be married.
