Am I in trouble?

Answered by attorney Harun Kazmi

Hello Theresa. I am not sure I follow your story all the way. Were you processing your Immigrant Visa based on your marriage to a US citizen? Did the consulate give you an option to submit the missing papers? Once you violate ESTA by overstaying, you cannot use it again. You will only be barred for 3 years if you overstayed your 90 days by another 180 days.  You can contact me with further information at: harun@kvisalaw.com

As you are a permanent resident, it will take your wife about 2 years if you start now. This does not include the processing time for the visa at her home consulate.

Assuming you have done the paperwork correctly, and assuming they match-up your two separate application filings, the government is often taking 10-16 months on these cases.
