If I've been approved for deferred action and get married afterwards to a u.s. citizen, would that allow me to continue staying in the U.S. while I fi

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
Your marriage to a US citizen means you may apply for permanent resident status, but you must obtain a waiver of the unlawful presence bar before you can get your green card.  After March 4th, you can apply for that waiver from within the US, but you will first have to get married and your spouse will have to file an I-130 petition for you.  Once that I-130 petition is approved, you can apply for the provisional waiver here in the US.  If that is approved, you can go to your home country and obtain an immigrant visa and return as a permanent resident.

How do I get the I-485 interview for my minor son which was scheduled on Aug/15/2017?

Answered by attorney Sheree D Wright
Immigration lawyer at IBF Law Group
Once you become a citizen it should have changed status. I suggest calling USCIS to update your status to US Citizen on his filing, or reach out to an experienced attorney in your area.

Can my son who is a minor attend school while awaiting i-130 approval

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
I will assume for purposes of the question that you and your son are both in the US at this time and that you are sponsoring him for permanent residence. Under that circumstance, your son would have to be in legal immigration status until the time that you file for his I-485 adjustment of status application since you are a permanent resident and not a US citizen. If he is in the country as a visitor, it is a violation of visitor status to attend schooling. The filing of an I-130 petition alone does not insulate you from a potential violation. Once you file for his I-485, the law in essence freezes his status from then on even if he begins to attend schooling.
