If I am a permanent resident but in proceedings, can I still apply I130 for my spouse who lives outside the USA?

Answered by attorney Bruce A. Coane (Unclaimed Profile)
Immigration lawyer at Coane & Associates, PLLC
A permanent resident can file an I-130 for their spouse even though they are in proceedings. of course, if the permanent resident gets stripped of their green card by the judge, it would nullify the spouse's pending I-130.

What can I do if my US citizen husband is abusing me?

Answered by attorney Lana Vladimirovna Kurilova Rich (Unclaimed Profile)
Immigration lawyer at Lana Kurilova Rich PLLC
You should go to a shelter! You should get away from him. You are suffering serious abuse and you need help. Do not worry about your immigration status; under these circumstances, you should be able to get your status because your USC husband is abusing you. It will be a long and difficult process, but it is better than to continue tolerating abuse. If you do not know where to go, just go to your nearest police department and tell them what is going on. If you feel you are in danger.

What should the family do from Former Green Card Holder to Tourist Visa?

Answered by attorney M. Gabriela Ungo
Immigration lawyer at GC Ungo Immigration
Former green card holders are still eligible to apply for a B2 tourist visa at their home consulates. You would have to overcome INA section 214(b), related to immigrant intent though.
