Can somebody who overstays a visa waiver adjust their status to obtain a work permit and residency?

Answered by attorney Francis John Cowhig (Unclaimed Profile)

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. First of all, on what grounds would you be eligible for an immigrant visa and/or work authorization. I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options.

Is there an H1B Grace Period after quitting my job?

Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
There is no grace period if your qualifying employment is terminated. Although a 4-weeks overstay does not make you inadmissible (a 3-year bar to entry is triggered by an overstay for 180 days), it can make getting a U.S. visa in the future very difficult. You might try convincing your employer to give you an unpaid leave of absence under the Family & Medical Leave Act, and postpone the official date of your separation from the company.

What are the ways to legalize status as a DACA recipient?

Alexander Joseph Segal
Answered by attorney Alexander Joseph Segal (Unclaimed Profile)
Immigration lawyer at The Law Offices of Grinberg & Segal, PLLC
There is absolutely NOTHING in your post to suggest that you could seek an immigrant status in the USA. As you know, DACA is not a status. It is a stay of execution. In your case, execution of your deportation order with some boons like EAD. That is all. If you want a more optimistic answer, I suggest you quit posting on the internet and start looking for a good immigration lawyer to have a consultation. Good Luck.
