The answer is that you have every right to file for support payments as anyone else. Although your lack of lawful status in the US is a problem, I would state the risk of you running into trouble as a result of trying to enforce Mr. Deadbeat's obligations is very low. Unless I am missing something, Immigration and Customs Enforcement is generally not looking at child support enforceecases as a priority source of immigration law enforcement. Hope this helps. You must both appear at the interview.  The foreigner in the relationship is required by law to report any change in address within 10 days, but the US citizen is not required to report an address change.  If the separation is merely temporary, explain everything at the interview and document your joint lives together as husband and wife and you should be fine.  A change of address notification can be filed online at the USCIS.GOV website.
