How much will it be to fix their citizen status?

Answered by attorney Francis John Cowhig (Unclaimed Profile)
Immigration lawyer at Francis John Cowhig
There is no set fee schedule for how much an attorney charges for his or her services. All attorneys charge differently depending on their experience, locality, complexity of the case, etc. I suggest that you interview a number of attorneys and retain the one you feel most comfortable with and can afford.

Im a permanent resident and my mother became a citizen before i turned 18. Would derivative citizenship apply in my case? How would i claim?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
If you were living together with your mother with permanent residence and in her legal custody when your mother became a citizen, you would have become a US citizen at the time that she became one. You would claim it by either filing for a US passport application or filing for an N-600 application for certificate of citizenship. Can I marry him and be his sponsor to apply for residence even if he has a criminal history?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Although not completely clear from your question, I presume that you are a U.S. citizen and that your fiance entered the U.S. lawfully and with inspection (showed a valid visa when he entered. In that event, upon becoming married you may sponsor him in an adjustment of status application process by which he will seek to become a Lawful Permanent Resident (get a "Green Card"). As part of that application process, he will need to address his three DUI cases, and depending upon the details he may be required to provide court-certified copies of arrest disposition documents and even may be required to provide evidence that he is not a "habitual drunkard" - an awkward term used by the USCIS in assessment of adjustment of status eligibility. It would be wise for you and your fiance to consult with an immigration attorney who, after learning all the relevant details, could advise about immigration eligibilities, options and strategies, and could offer legal representation in the often complex application process.
