My daughter is an USA citizen and is filing an I130 form for me. Can I stay or do I have to leave Before my legal status is due on June

Answered by attorney Stephen Arnold Black
Immigration lawyer at The Law Office of Stephen A. Black
If your daughter is over 21 then she can sponsor you as an immediate relative. Since you entered as a visitor then u may have a problem adjusting status since your intent was to visit and not to adjust status. Consequently it would be safer for u to process your petition overseas. Thus u should not overstay your visa if u don’t want any problems.

My husbard was convicted of a felony and served time. Will he be deported if he applies to replace/renew his green card. Has been LPR 30 years.

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
Removal/deportation depends on a variety of factors.  Your husband should NOT apply to renew his I-551 (Green Card) without speaking with a lawyer first.  Your lawyer will need to review your husband's criminal record in detail before making a recommendation.  I would be glad to assist you further if you would like.

Can i travel outside the US with an EAD card and re-enter?

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
No, the EAD card alone does not confer travel benefits.  If you applied for Advanced Parole at the same time you applied for your EAD card, then the EAD card will have a notation indicating that it may be used for advanced parole (i.e., travel).   If you send me an image of the card I can confirm whether your card includes advanced parole.
