Can I leave the US if the I-130 is in process?

If he is a U.S. citizen and you are in the U.S. then you should file both the I-130 and I-485 to adjust status. Once these are filed you can't leave until you have your travel document (advance parole). You may want to get legal guidance throughout the process as there are landmines. You can leave with the I-130 pending but then you may be remaining in Canada until the process is complete 8-12 months.

To petition the government for your mother's immigrant visa, you have to become a U.S. citizen, first. From the day you file papers for her, the process will take about a year. To avoid any delays, make sure to file for your naturalization 3 months before the 5th anniversary of your green card (3rd anniversary if you received your green card through a marriage to a U.S. citizen), file your tax returns, and show on your tax returns enough income to qualify for sponsoring your mother (at least $19000 a year if you live alone, over $24000 - if you have one dependent on your taxes, over $29000 - if you have 2 dependents, and so on).

From the conditional resident card grant. However, in order to apply within 90 days of the third year anniversary, you must have the required three years of continuous physical presence prior to the conditional resident grant and must have three years of good moral character, as well. Otherwise, the case may be denied. If this seems confusing, and I strongly recommend an appointment with a competent and experienced immigration attorney. Good luck.
