Can I petition for only my father?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
There is no legal requirement that an adult child sponsor and apply for both parents, and indeed the child may petition for just one parent. Significantly more information is needed, however, to assess eligibilities, options and strategies for you to sponsor your father. Especially since you are less than thoroughly familiar with immigration processes, it would be wise for you and your father to work with an immigration attorney.

Do I have to stay in the United States if you get married for citizenship?

default-avatar
Answered by attorney William D. Fong (Unclaimed Profile)
Immigration lawyer at Fong Ilagan
After you marry and file the petition, it should only take 90 days for the travel authorization (advance parole) to be issued to your husband. He needs to have this to travel internationally or his leaving will constitute an abandonment of the petition. There is no visa for the spouse of a US citizen to travel and return, it is the advance parole he needs, please plan accordingly and note that the USCIS does have delays in issuance.

If I just found my I 94 expired but still have valid visa till month end and I am leaving the country this month end, should I still extend my I 94?

Answered by attorney M. Gabriela Ungo
Immigration lawyer at GC Ungo Immigration
You can leave by the end of the month. The problem is overstaying the date stamped on your I-94 more than 180 days, then you will be barred from re-entry for 3 years (if you overstay more than 1 year, the bar is 10 years). The visa is your "ticket" to enter the U.S., it controls your "entry" to the U.S. and he I-94 controls the stay.
