It generally takes 6 months to a year from the time that you start the process. He will have to go through consular processing. I suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze you case, advise you of your options and help you with the process.

He can apply for his 10 year green card even in a divorce situation. Not sure about custody. That question needs to be sent to a family law attorney (not immigration).

It depends, why was he in immigration proceedings. If it was criminal, there will probably be some difficulty. If he overstayed by more than 180 days he is barred from returning for 3 years but if he overstayed for more than a year he is barred for 10 years. It is impossible to answer you question, without more information. Take your file to an immigration attorney and they can advise you on what is possible, you aren't going to be able to bring him back without one anyways.
