The law for marriages vary from state to state. It would depend on that state. Most states, from what I've heard, allow tourists to get married. And, as you know, a handful of states allow gay marriage. Of course, marrying a green card holder is no automatic way to stay here. There is a quota for visas in that category.

You cannot force him to stay married to you but you can file for a divorce or annulment. Contact a divorce attorney to advise you on this and whether you are eligible for any maintenance. Maintenance (formerly called alimony) is rarely granted for a short marriage unless you are disabled.
