What is the process for a temporary green card holder deportation from the United states of America after criminal conviction was vacated?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
You may be eligible for a waiver of the "permanent" bar after you have been outside the US for 10 years. At that time, you could apply for one and it would be adjudicated in accordance with law. One of the things that will be considered is the aggravated felony even if the criminal conviction was vacated. In the eyes of DHS, an individual can be declared inadmissible if he or she admits the facts of the barring act. I will be filing the form i-130, i-131, i-485, and i-765. While I wait, do I qualify to get financial aid to go to university?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Filing the paperwork for permanent residence will generally not be enough to obtain financial aid from a college or university. However, colleges and universities have different packages dependent upon scholarship/financial aid, and you could inquire of the colleges and universities in which you are interested as to whether you might be eligible for some type of assistance. How strict is the 30-month travel rule when applying for citizenship?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Where individuals are applying for naturalization based on the five-year rule, the 30 month physical residence rule is mandatory. The absolute minimum physical presence is 30 months, and you should not make an application until you are sure that you have 30 months physical residence during the past 60 months before application. I further note that many immigration officers may give individuals problems even where they meet the bare minimum eligibility requirement of 30 months.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
