What can I do if the background check for I751 was delayed?

Delays happen. Just wait. However, if you are within 90 days of having 3 years of residency and are still married and living with your spouse, you can apply for naturalization.

Will my green card petition be considered invalid?

You do not have to provide your dad with the information if you do not feel comfortable. As long as the marriage was legit (and it was-they even had a child together), you are OK.

If I am a permanent resident in the USA, how can I get my fiance into the USA?

default-avatar
Answered by attorney Christine Green (Unclaimed Profile)
Immigration lawyer at Law Offices of Christine Green
Only U.S. citizens can file a K-1 fiancee visa which would allow the fiance to join him/her in the U.S. for the purposes of getting married. As a legal permanent resident (LPR), you would have to get married before you could file a petition for your spouse. Also, a spouse of an LPR does not have a visa number immediately available to him/her, so there would be a significant wait time. How long before you are eligible to naturalize? As a naturalized U.S. citizen, you would have the option to file a K-1 fiancee visa.
