In order to fix my boyfriend's papers, do I have to marry him?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
There is no visa category by which one may sponsor a boyfriend or girlfriend, but there are visa categories for sponsoring a spouse. If you and your boyfriend are not ready to become married, then depending on many circumstances (including his present immigration status, his job skills, the availability of a qualified employer willing to sponsor him, etc.), he may have other options for attaining immigration benefits.

What can I do to get a spouse back atfer overstaying a visa?

If you are a US citizen, you can apply for your spouse to get a green card. If your spouse overstayed over 180 days and is currently outside the country, you will need to file a waiver. I do not recommend doing this without the assistance of a competent immigration attorney. Best wishes.

Is it possible for my girlfriend to stay in the US if her visa has expired? How?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
There is no visa category by which a boyfriend may petition for a girlfriend, but there is a category by which a U.S. citizen may apply for a spouse to adjust status in the U.S. to become a Permanent Resident (to get a "Green Card"), and this is true even if the foreign national spouse may have overstayed her student visa. If you are your girlfriend are contemplating becoming married, then it would be wise for the two of you to consult with an immigration attorney who, after learning all of the relevant details, could advise about immigration eligibilities, options and strategies, and offer legal representation for the application process.
